Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Elements Casino Alchemy app for iPhone and iPad (the "App") and the website at https://elmcasinoalchemy.com (the "Website"). We refer to them together as the "Service."

The Service is operated by ELEMENTS CASINO ALCHEMY LTD ("we," "us," or "our").

Please read these Terms carefully before using the Service. By downloading, installing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. About the Service

Elements Casino Alchemy is a single-player puzzle-collection game. Each spin of a slot-style machine harvests elemental ingredients. You fuse them in an alchemy lab, discover thirty elements, and complete story chapters, daily quests, and feats.

The Service is for entertainment only. The features of the Service may change over time.

2. No Real-Money Gambling

The Service does not provide real-money gambling. You cannot use it to place bets or wagers with money, deposit money, withdraw money, receive cash winnings or monetary prizes, exchange game results for money or for items of monetary value, or cash out any result.

The casino-style terms, reels, spins, symbols, and bonus-style features in the App are simulated for entertainment only.

3. No Purchases and No Currency

The App does not sell anything, and it does not require a purchase to play. It has no purchasable virtual currency and no redeemable virtual currency.

Counters, energy, scores, ingredients, and other values inside the App are part of the simulated game. They have no monetary value, cannot be bought or sold, cannot be transferred or redeemed, and do not create any payment obligation from us.

4. Eligibility

The Service is intended only for adults aged 18 and over. The App includes an age and play gate that you must pass before you can play. By passing it, you confirm that you are 18 or over, that you agree to these Terms and the Privacy Policy, and that your use of the Service is lawful where you live.

If you do not meet the minimum age, you must not download, install, or use the Service. The Service is not directed to children.

5. License to Use the App

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the App on an Apple device that you own or control, for lawful, personal, non-commercial entertainment.

All rights not expressly granted are reserved. The App is licensed to you, not sold.

6. Acceptable Use

You agree to use the Service lawfully and responsibly. You must not:

• copy, modify, translate, reverse engineer, decompile, or create derivative works from the App, except where the law allows it;
• remove or alter proprietary notices;
• circumvent technical protections or security features;
• distribute malware or attempt to interfere with our systems or the Website;
• scrape or automate access to the Website in a way that places an unreasonable load on it; or
• use the Service to misrepresent simulated gameplay as real-money gambling.

7. Intellectual Property

The App and Website, including their software, artwork, illustrations, 3D icons, text, names, and logos, are owned by us or our licensors and are protected by copyright and trademark laws. You may not use them except as these Terms allow.

8. Feedback

If you send us ideas, suggestions, or bug reports ("Feedback"), you grant us a worldwide, royalty-free, non-exclusive right to use that Feedback to operate, develop, and improve the Service. You are not required to send Feedback. Personal information in your Feedback is handled under our Privacy Policy.

9. Updates and Availability

We may release updates to the App. Some updates may be needed to keep using certain features, and failing to install them may affect how the App works.

We aim to keep the Service available, but we do not guarantee that it will always be available or error-free. We may change, suspend, or discontinue features where the law allows.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We do not guarantee any particular game result, the frequency of any in-game event, that the App will work on every device, or that the App will meet your expectations.

Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Because the App has no monetary value, the loss of a score, energy, a satchel, progress, or any other in-game state is not a financial loss recoverable from us.

Because the App is provided free of charge, our total liability to you is limited to the minimum amount that applicable law allows. This limitation does not apply where the law does not allow it to be limited.

12. Consumer Rights

Nothing in these Terms removes or limits rights that you have under mandatory consumer law in your country or region of residence.

13. Indemnity

To the extent permitted by law, you agree to indemnify us against claims that arise from your unlawful use of the Service or your material breach of these Terms. This does not apply where the law does not allow it.

14. Termination

You may stop using the Service at any time by uninstalling the App. We may suspend or terminate your access where reasonably necessary, for example because of a material breach of these Terms, fraud, or unlawful activity.

When your right to use the Service ends, your license ends. Sections that by their nature should survive termination will continue to apply.

15. Apple App Store Terms

If you downloaded the App from the Apple App Store, these additional terms apply.

You acknowledge that these Terms are between you and ELEMENTS CASINO ALCHEMY LTD, and not Apple Inc. ("Apple"). We, not Apple, are responsible for the App and its content, subject to applicable law. Apple has no obligation to provide maintenance or support services for the App. We, not Apple, are responsible for addressing claims relating to the App, including claims that it infringes third-party intellectual property rights.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the App must also comply with Apple's applicable terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the place where ELEMENTS CASINO ALCHEMY LTD is established, without regard to conflict-of-law principles. If you are a consumer, you may also rely on the mandatory consumer protections of your country of residence.

Before starting formal proceedings, please contact us at support@elmcasinoalchemy.com so that we can try to resolve the matter informally. Disputes will be heard by the competent courts of the place where we are established, unless mandatory law gives you the right to bring a claim in your home courts.

17. Changes to These Terms

We may update these Terms. We will revise the "Last updated" date at the top of this page. Where the law requires it, we will give notice of material changes before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms, to the extent the law allows.

18. Other Terms

• Force majeure. We are not responsible for delays or failures caused by events outside our reasonable control, such as network outages, hosting failures, or natural events.
• Severability. If a provision is unenforceable, the rest of these Terms continue in effect.
• No waiver. Our failure to enforce a right is not a waiver of that right.
• Entire agreement. These Terms, the Privacy Policy, the End-User License Agreement, and any terms that the App's store presents to you form the agreement between you and us about the Service.
• Language. If these Terms are translated, the English version controls to the extent the law allows.

• does not contain purchasable or redeemable virtual currency; and
• does not allow players to cash out gameplay results.

Game results, simulated wins, counters, and bonus-style features have no monetary value. Success in a simulated casino-style game does not imply, predict, or guarantee success in real-money gambling.
