End-User License Agreement

This End-User License Agreement ("EULA" or "Agreement") is a legal agreement between you and ELEMENTS CASINO ALCHEMY LTD ("we," "us," or "our") governing your download, installation, and use of the Elements Casino Alchemy app for iPhone and iPad (the "Application"), including its updates and related content.

Please read this Agreement carefully before you download, install, or use the Application. By doing so, you agree to be bound by it. If you do not agree, do not download, install, or use the Application.

1. Purpose of the Application

Elements Casino Alchemy is a single-player entertainment game. Each spin of a slot-style machine harvests elemental ingredients, which you fuse in an alchemy lab. The Application is intended solely for entertainment.

The Application does not provide real-money gambling. It does not accept bets, wagers, or deposits, does not award cash prizes or cryptocurrency, does not sell virtual currency, and does not allow simulated results to be cashed out.

2. License Grant

Subject to your compliance with this Agreement, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use the Application on an Apple device that you own or control.

The license is granted solely for personal, lawful, non-commercial, entertainment use. The Application is licensed, not sold. We and our licensors reserve all rights not expressly granted to you.

3. Eligibility

You may use the Application only if you are 18 years old or over. The Application includes an age and play gate that you must pass before playing. By using the Application, you confirm that you meet this requirement and have the legal capacity to enter into this Agreement.

The Application is not directed to children.

4. No Virtual Currency and No Real-Money Play

The Application does not operate a purchasable or redeemable virtual currency. Counters, energy, ingredients, scores, and similar values inside the Application are part of the simulated game. They have no monetary value, cannot be bought, sold, transferred, or redeemed, and do not create any payment obligation from us.

Simulated results do not entitle you to money, prizes, property, or any other item of monetary value.

5. Restrictions

Except where applicable law expressly permits, you must not:

  • copy, reproduce, distribute, rent, lease, lend, or sell the Application;
  • modify, adapt, translate, or create derivative works from the Application;
  • reverse engineer, decompile, or disassemble the Application, or attempt to derive its source code;
  • bypass or disable security controls or technical protections;
  • remove or alter copyright, trademark, or other proprietary notices; or
  • use the Application in a way that violates applicable law.

Nothing in this section limits rights that the law does not allow us to restrict.

6. Ownership

The Application and all of its original elements remain the property of ELEMENTS CASINO ALCHEMY LTD or its licensors. These include the software, user interface, design, layout, artwork, 3D icons, illustrations, text, audio and video, and branding. You receive no rights other than the limited license in this Agreement.

Open-source components, if any, remain subject to their own license terms, which control for those components.

7. Updates

We may provide updates, bug fixes, and new versions of the Application. Updates may change features, correct errors, improve performance, or address security issues. Some updates may install automatically depending on your device settings. We do not guarantee that any particular feature will remain available indefinitely.

8. Compatibility and Connectivity

The Application runs on iPhone and iPad with iOS 16.0 or later, in portrait orientation. We do not guarantee compatibility with every device or operating-system version.

Gameplay does not require an internet connection. Your progress and settings are stored on your device.

9. Application Store Terms

If you obtained the Application from the Apple App Store, the following applies in addition to this Agreement:

  • This Agreement is between you and ELEMENTS CASINO ALCHEMY LTD, and not Apple Inc. ("Apple").
  • We, not Apple, are responsible for the Application and its content, subject to applicable law.
  • The license granted to you is limited to use on Apple-branded products that you own or control, subject to Apple's applicable usage rules and any permitted Family Sharing arrangements.
  • Apple has no obligation to provide maintenance or support services for the Application.
  • We, not Apple, are responsible for addressing claims relating to the Application, including claims that it infringes third-party intellectual property rights.
  • Apple is not responsible for the Application's content.
  • Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you, on acceptance of this Agreement.

Where mandatory Apple requirements conflict with this Agreement, those requirements apply to the extent of the conflict.

10. Support

For support with the Application, please email support@elmcasinoalchemy.com. We decide the types of support we provide, and we are not obliged to support outdated versions of the Application, unless the law requires it.

11. Privacy

Our handling of personal information in connection with the Application is described in our Privacy Policy. The Application stores progress and settings on your device, and it does not include advertising, analytics, or crash-reporting services. Please read the Privacy Policy before using the Application.

12. Disclaimers and No Warranty

To the maximum extent permitted by applicable law, the Application is provided "as is" and "as available." We disclaim express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and uninterrupted operation.

We do not guarantee that the Application will be error-free, that every feature will function on every device, or that defects will always be corrected. We make no warranty about simulated gameplay outcomes, which are provided for entertainment only.

Mandatory consumer warranties that the law does not allow us to exclude remain unaffected.

13. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for indirect, special, incidental, consequential, exemplary, or punitive damages arising from your use of the Application or your inability to use it.

Simulated scores, counters, outcomes, and gameplay progress have no monetary value, and their loss does not constitute a financial loss.

Because the Application is provided free of charge, our total liability is limited to the minimum amount that applicable law allows. Nothing in this Agreement excludes liability where the law does not allow it.

14. Consumer Rights

Nothing in this Agreement excludes, restricts, or modifies rights that cannot lawfully be excluded under applicable consumer-protection law. If mandatory consumer law applies to you, those rights remain effective.

15. Termination

You may terminate this Agreement at any time by uninstalling the Application from your devices. We may suspend or terminate your license where reasonably necessary, for example because of a violation of this Agreement, illegal activity, or attempts to interfere with the Application.

When this Agreement ends, your license ends, you must stop using the Application, and sections that by their nature should survive will continue to apply.

16. Changes to the Application and to This Agreement

We may change the Application at any time, including its features and game content. We may update this Agreement to reflect changes to the Application, to the law, or to application-store requirements. We will revise the "Last updated" date at the top of this page and give any notice the law requires. Continued use of the Application after an updated Agreement takes effect means you accept it, to the extent the law allows.

17. Export Compliance

You may not use, export, re-export, or transfer the Application in violation of applicable export-control laws, trade restrictions, or economic sanctions.

18. Governing Law and Disputes

This Agreement is governed by the laws of the place where ELEMENTS CASINO ALCHEMY LTD is established, without regard to conflict-of-law principles, except where mandatory law requires a different result. If you are a consumer, you keep any mandatory legal protections available in your country or region of residence.

Before starting formal proceedings, please contact us at support@elmcasinoalchemy.com so that we can try to resolve the matter informally. Disputes will be heard by the competent courts of the place where we are established, unless mandatory law gives you the right to bring a claim in your home courts.

19. Other Terms

  • Force majeure. We are not responsible for failures or delays caused by events outside our reasonable control.
  • Severability. If a provision is unenforceable, the rest of this Agreement continues in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign this Agreement without our written permission. We may assign it in connection with a merger, acquisition, or sale of the Application, subject to applicable law.
  • Third-party beneficiaries. Except for Apple as described in section 9, this Agreement creates no rights for third parties.
  • Entire agreement. This Agreement, the Terms and Conditions, the Privacy Policy, and any feature-specific terms presented to you form the agreement between you and us about the Application. If they conflict, the more specific term applies to that feature.
  • Language. If this Agreement is translated, the English version controls to the extent the law allows.

Important Entertainment-Only Disclosure

Elements Casino Alchemy is a simulated entertainment application. Users cannot place real-money bets, wager money, deposit money for gameplay, withdraw money, receive cash winnings or real-world prizes, purchase or redeem virtual currency, transfer gameplay value, or cash out simulated outcomes.

Simulated gameplay outcomes have no monetary value. Success in a simulated casino-style game does not imply, predict, or guarantee success in real-money gambling.
